Terms of Use

1. Nature of Services

Smart Geeks (the "Service Provider") is a physical retail storefront located at Unit 2, 13018 84 Ave, Surrey, BC. Our services are strictly limited to physical hardware installation, mechanical maintenance, and component-level fitting. We do not provide remote technical support, software troubleshooting, virus removal, or third-party consumer technical support as defined by Google Ads policies.

2. Right to Repair Compliance

In accordance with Canadian Bill C-244, Smart Geeks provides hardware maintenance and diagnosis that may involve the circumvention of Technological Protection Measures (TPMs) for the sole purpose of physical repair or maintenance. We do not engage in copyright infringement or the unauthorized distribution of software.

3. Estimates and Diagnostic Fees

A physical hardware analysis fee may apply to any device brought in for service. This fee covers the labor required for disassembly and component testing and will be credited toward the final hardware installation if you choose to proceed with our recommendation.

4. Data Loss & Customer Responsibility

4.1. Backup Requirement: Hardware maintenance involves physical risks. It is the Customer's sole responsibility to back up all data, software, and files prior to bringing a device to Smart Geeks.

4.2. Liability: Smart Geeks shall not be held liable for any loss of data, corruption of software, or loss of use of the device during the physical installation process.

5. Warranty of Service

5.1. Labor: We provide a 30-day warranty on labor and installation of components.

5.2. Parts: Hardware parts (SSDs, RAM, Screens, etc.) are covered by their respective manufacturer's warranties. Smart Geeks will assist in the physical removal of a failing part for warranty purposes, though additional labor fees may apply.

6. Abandoned Property

Devices not picked up within sixty (60) days of service completion notification will be considered abandoned. Smart Geeks reserves the right to recycle or sell abandoned hardware to recover the costs of labor and storage, in compliance with BC provincial laws.

7. Payment Terms

Payment in full is required at the time of pickup. We accept major credit cards, debit, and cash. We do not offer billing terms or "pay-later" schemes for consumer hardware services.

8. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada.
